ADA Alterations (Building) Code
ADA and 508 (ICT) Sec.36.402 Alterations. Sections (a), (b) and (c) are the core.
This section is a major part of ADA requirements regarding accessibility compliance requirements for the retail checkout, -ADA operable parts and operation. The ADA comes in sections that often are compiled and not very direct. ADA standards are divided into categories like construction, measurement, and operability. Retailers might misinterpret these as standalone requirements instead of understanding their interconnectedness.
For example: ADA reach and range is (only) construction and measurement. It gives nothing else and that is when sections like ADA 309 operable parts and 309.4 operation attach that does address accessibility.
This is where the ADA operable parts and operation comes in and it goes into other accessibility requirement sections that attach like ADA 308.2 limited reach and strength and then visual screen accommodation.
Now the attachment of the payment card industry (PCI) requirements for (POI) accessibility and Privacy like VISA TAGD 3.2 Section 2.6 accessibility. Then to PCI for physical PIN privacy use requirements which was adopted from the ISO 9564 security requirements. Building Code Requirements.
(a) General. (1) Any alteration to a place of public accommodation or a commercial facility, after January 26, 1992, shall be made to ensure that, to the maximum extent feasible, the altered portions of the facility are readily accessible to and usable by individuals with disabilities, including individuals who use wheelchairs.
(2) An alteration is deemed to be undertaken after January 26, 1992, -(yes, 1992)- if the physical alteration of the property begins after that date.
(b) Alteration. For the purposes of this part, an alteration is a change to a place of public accommodation or a commercial facility that affects or could affect the usability of the building or facility or any part thereof.
The retail Checkout falls under alterations for building code requirements and generally deals with a fixed (countertop) element. A fixed mounted point-of-sale terminal has to be an assistive technology mount. If multi-lane, one every fifth lane is required to have an assistive technology mounted point of sale terminal for checkout.
(2) If existing elements, spaces, or common areas are altered, then each such altered element, space, or area shall comply with the applicable provisions of appendix A to this part.
(c) To the maximum extent feasible. The phrase “to the maximum extent feasible,” as used in this section, applies to the occasional case where the nature of an existing facility makes it virtually impossible to comply fully with applicable accessibility standards through a planned alteration. In these circumstances, the alteration shall provide the maximum physical accessibility feasible. Any altered features of the facility that can be made accessible shall be made accessible. If providing accessibility in conformance with this section to individuals with certain disabilities (e.g., those who use wheelchairs) would not be feasible, the facility shall be made accessible to persons with other types of disabilities (e.g., those who use crutches, those who have impaired vision or hearing, or those who have other impairments).
